Terms and Conditions (GTC)

  1. scope

1.1 The General Terms and Conditions (hereinafter "GTC") of Plantago Handels GmbH, Jakob-Stainer-Gasse 17/1, 1130 Vienna, info@shinkoko.at, (hereinafter "Seller") apply to all orders and contracts that an entrepreneur or a consumer (in both cases hereinafter "Customer") places or concludes via our online tea shop "shinkoko.at".

1.2 Any deviating or additional terms and conditions of the customer require the express written consent of the seller to be valid.

1.3 If the contracting party is an entrepreneur, their general terms and conditions are explicitly not recognized. They only become part of the contract if Plantago Handels GmbH has expressly agreed to the general terms and conditions in writing.

  1. Contract conclusion

2.1 The presentation of the products on shinkoko.at does not constitute a legally binding offer, but rather a non-binding invitation to order. The prices listed for the products include sales tax, as well as any duties and surcharges, but not shipping costs.

2.2. The order begins with the selection of a product. This can be placed in the shopping cart (“Add to shopping cart”).

2.3 Once the customer has selected all the goods, he can continue the ordering process in the shopping cart by clicking on the "Checkout" button. This will redirect him to a page that lists the payment options for the customer to choose from. The price stated in the shopping cart is the total price, including statutory sales tax, as well as any duties, surcharges and shipping costs, as soon as the delivery address is specified.

2.4 The customer can select a payment option (see “3. Payment options”). If the data for order processing has not already been saved, it will be recorded subsequently. The customer has the option of saving his data for future payments by clicking on the button “Save my data for faster payment”.

2.5 By clicking the button "I have read and accepted the Terms and Conditions", the customer declares that he/she accepts the Terms and Conditions as a binding part of the contract.

2.6 By clicking the "Pay now" button, the customer places a binding order for the goods contained in the shopping cart. This is considered a binding offer from the customer.

2.7 The Seller accepts the Customer’s offer by one of the following actions:

- Delivery of the ordered goods

- Request for payment

- Sending an order confirmation to the customer

If the seller performs two or more acts, the first act shall be deemed to be the time of acceptance or conclusion of the contract.

2.8 The contract, including the General Terms and Conditions, will be sent to the customer by email.

2.9 The customer is responsible for providing a correct email address for contact and order processing. This email address must be suitable for receiving communications relating to this order.

2.10 The contract language is German.

2.11 The contract is concluded with Plantago Handels GmbH, Jakob-Stainer-Gasse 17/1, 1130 Vienna.

  1. Payment options

3.1 Payment can be made using one of the payment methods listed below.

3.2. PayPal: If payment is made via “PayPal”, the payment will be processed via PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg. To make the payment via PayPal, the customer must be registered with PayPal, authenticate themselves with their access data and confirm the payment order. The payment transaction will be carried out by PayPal immediately after the order has been placed.

3.3. Shop Pay: If payment is made via “shop Pay”, the payment is processed by Shopify Inc. 151 O'Connor Street, Ground Floor, Ottawa, ON K2P 2L8, Canada. The email address, credit card, shipping and billing data are stored securely and can be used again for the next order. The invoice amount is collected immediately after the order is received.

3.4. Credit card: If payment is made by credit card, you can choose between Visa, Mastercard and Maestro. The customer sends us the credit card details when placing the order. The credit card is charged immediately after the order process has been completed.

3.5 Apple Pay: If payment is made via “Apple Pay”, the payment will be processed via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA (“Apple”). To do this, the customer must be registered with Apple, have activated the Apple Pay function, identify themselves with their login data and confirm the payment instruction. The payment transaction is carried out by Apple Pay immediately after the order is placed.

3.6 Google Pay: If payment is made via “GPay”, the payment will be processed via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). To do this, the customer must be registered with Google, have activated the Google Pay function, identify themselves with their access data and confirm the payment instruction. The payment transaction is carried out by Google Pay immediately after the order is placed.

3.7 eps transfer: If payment is made via “eps transfer”, the customer is connected directly to their usual online banking system. After registration, a pre-filled transfer form is displayed. The customer then selects their debit account and confirms the transfer. No additional registration is required to use the EPS online transfer.

3.8 Invoice with Klarna: If payment is made by "Invoice with Klarna", the transaction is processed via Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"). After completing the order, the customer receives a message from Klarna with the payment details. The customer can pay the invoice contained therein in the Klarna app or online within ## days.

3.9 Pay immediately with Klarna: If payment is made via “Pay immediately with Klarna”, the transaction is processed via Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden (“Klarna”). The customer can pay for orders using their online banking details. Klarna Pay immediately establishes a connection to the customer’s bank account and the amount is immediately debited from the bank account.

3.10 If the goods are picked up directly in the shop (Jakob-Stainer-Gasse 17/1, 1130 Vienna), payment is made in cash.

  1. Delivery and shipping conditions

4.1 Delivery will take place within a few days, unless otherwise agreed.

4.2 Delivery will be made to the delivery address specified by the customer.

4.3 Please refer to our shipping conditions for the respective shipping costs.

4.4 If the seller incurs additional costs because the customer has provided an incorrect delivery address or delivery recipient or other circumstances within the customer's sphere of influence prevent, hinder, delay or complicate delivery, these costs must be reimbursed to the seller by the customer. This also applies if the customer was temporarily unable to accept the goods.

4.5 The goods can also be picked up in person at the address Jakob-Stainer-Gasse 17/1, 1130 Vienna. In this case, no delivery or shipping costs will be incurred.

4.6 Otherwise, the statutory provisions apply.

  1. Retention of title

The delivered goods remain the property of the seller until full payment has been made.

  1. Right of withdrawal

6.1 If the customer is a consumer, he or she is entitled to the statutory right of withdrawal.

6.2 The right of withdrawal is excluded for goods that are delivered sealed and are not suitable for return for reasons of health protection or hygiene, provided that their seal has been removed after delivery (unsealing). This applies to unsealing by opening tea packaging, bamboo products, and all other goods delivered with a seal. (Section 18 Paragraph 1 Item 5 of the Distance and Away Sales Act)

7.1 The statutory warranty rights apply.

7.2 The customer is liable for damage to the ordered goods from the time they are delivered to the customer (Section 7b of the Consumer Protection Act).

  1. Applicable law, place of jurisdiction

9.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

9.2 The place of jurisdiction for all disputes arising from this contract is Vienna. The statutory provisions remain unaffected.

  1. Final provisions

Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
